The Delhi High Court has rejected the bail plea of Md. Shahnawaz, an accused in a dowry death case. Justice Girish Kathpalia dismissed the application, citing the seriousness of the offense and the evidence on record.
The case, registered at Nabi Karim police station, involves sections 304B, 498A, 201, and 34 of the Indian Penal Code. Subsequently, a charge under Section 302 IPC was added based on a post-mortem report. The complaint alleged that the deceased died by suicide due to dowry harassment.
Prosecution presented medical evidence indicating injuries caused by blunt force before death. This led to the suspicion of murder, opposing the accused’s bail plea. The defense argued that injuries could have occurred during burial, but the court upheld the pre-death assault possibility.
The court differentiated this case from a co-accused’s, noting the direct allegations against the accused, who was the deceased’s husband. Testimonies of the deceased’s sisters supporting the prosecution were also considered. The court, based on the gravity of the offense and trial evidence, denied bail to the accused.
