The Supreme Court has resolved a plea from the Maulana Kamaluddin Welfare Society regarding the Bhojshala Temple-Kamal Maula Mosque conflict. The Court expressed confidence in the Madhya Pradesh High Court’s ability to address objections, particularly those related to videography during the Archaeological Survey of India (ASI) survey.
A civil appeal was heard by a Bench led by Chief Justice of India Surya Kant, challenging the Indore Bench of the Madhya Pradesh High Court’s handling of objections to the ASI survey report. The apex court noted that objections were submitted by parties after receiving the survey report, which included videography and photography of the disputed site.
The Supreme Court emphasized that the High Court must consider all objections, including those identified through videography, in line with principles of natural justice. It directed the Madhya Pradesh High Court to make a comprehensive decision on all objections, including those arising from the videography process.
The Court clarified that it refrained from expressing any opinion on the dispute’s merits, leaving all issues for the Madhya Pradesh High Court to adjudicate. Both parties were instructed to present their arguments before the High Court for further consideration.
