Supreme Court Rejects PIL Alleging Police Excesses at Magh Mela

The Supreme Court dismissed a Public Interest Litigation accusing police of mistreating Swami Avimukteshwaranand’s followers during the Magh Mela in Prayagraj, Uttar Pradesh. The court stated that law and order issues are under the state government’s jurisdiction. The petitioner was advised to approach the appropriate authorities with a representation for action within the legal framework.

Advocate Ujjawal Gaur filed the PIL under Article 32, highlighting alleged arbitrary and violent state actions during the Magh Mela, especially on Mauni Amavasya. The petition mentioned that police had mistreated minor religious students accompanying Swami Avimukteshwaranand Saraswati during a holy dip at the Sangam on January 18.

The petition referenced videos and images showing police allegedly assaulting minors, pulling them by their hair, and using physical force. The petitioner argued that such actions violated constitutional provisions against cruel, inhuman, and degrading treatment. The plea also questioned notices issued by the Prayagraj Mela administration regarding the use of the Shankaracharya title and possible consequences.

The petitioner urged the Supreme Court to establish uniform Standard Operating Procedures for state engagements with religious leaders during events like the Magh Mela. The petition sought protection for the dignity and rights of ascetics and minor students. The Magh Mela, overseen by the Uttar Pradesh government, took place from January 3 to February 15, ending on Mahashivratri.
