  2. Property details (address, type, size, furnishing, etc.)
  3. Rent amount, payment mode, and due date
  4. Security deposit and refund terms
  5. Duration of tenancy (fixed term or month-to-month)
  6. Maintenance and utility responsibilities
  7. Prohibition clauses (e.g., no subletting, no commercial use)
  8. Jurisdiction for disputes (mention the city where the property is located)
  9. Digital signatures or signed hard copies with witness signatures

Dos and Don’ts for NRI Landlords

Dos

  • Use your NRO bank account for rent receipts.
  • Register the agreement if it exceeds 11 months.
  • Get the agreement digitally notarized or signed by your Indian representative (via Power of Attorney).
  • Mention TDS applicability if rent exceeds ₹50,000 per month.

Don’ts

  • Don’t hand over possession without receiving the security deposit.
  • Don’t leave out renewal terms or notice period.
  • Don’t depend only on verbal agreements.
  • Don’t skip mentioning the purpose of use (residential or commercial).

RENTAL AGREEMENT (SELF-DECLARATION FORMAT)

This Rental Agreement is made on this ___ day of ________, 20 between:

I, [Name of Owner], son/daughter of [Father’s Name], residing at [Permanent Address], holding Indian Passport No. [XXXXXXX], presently residing at [Overseas Address], hereinafter referred to as the “OWNER”,
AND

I, [Name of Tenant], son/daughter of [Father’s Name], residing at [Address], holding Aadhar No. [XXXX-XXXX-XXXX], hereinafter referred to as the “TENANT”.

DECLARATION

I, [Name of Owner], hereby declare that:

1. I am the lawful owner of the property situated at [Complete Property Address].
2. I have agreed to let out the said property to [Name of Tenant] for residential/commercial use for a period of [No. of months/years], commencing from [Start Date].
3. The agreed monthly rent is INR [Amount], payable on or before the [Due Date] of each month through [Bank Transfer / Cheque / UPI] to my NRO account no. [Account Number], IFSC: [Code].
4. A refundable security deposit of INR [Amount] shall be paid by the Tenant at the time of signing this agreement.
5. The Tenant shall use the premises only for lawful purposes and shall not sublet, assign, or misuse the property in any way.
6. All utility charges (electricity, water, gas, etc.) shall be borne by the Tenant.
7. Either party may terminate this agreement by giving [30/60 days] written notice.
8. The Tenant shall maintain the premises in good condition and return it in the same condition upon vacating, reasonable wear and tear excepted.
9. This agreement shall be governed by the laws of India, and any disputes shall be subject to the jurisdiction of courts at [City, State].
