The Central Bureau of Investigation (CBI) disclosed uncovering an alleged builder-bank nexus in a homebuyers fraud case and has submitted its ninth charge sheet against a real estate company, its directors, and bank officials. The case involves purportedly cheating homebuyers and financial institutions in connection with a housing project in Ghaziabad, Uttar Pradesh. The accused builder company, its directors, and certain bank officials are accused of engaging in a criminal conspiracy that led to losses for financial institutions and innocent homebuyers.
The investigation by the CBI unveiled that the builder company and its directors, in collaboration with bank officials and other individuals, allegedly enticed homebuyers and investors through false promises and deceitful representations to gain financially through illegal means. It was found that some bank officials misused their positions to aid the builder in illicit activities, breaching established banking norms. This misconduct allegedly favored the builder company financially while causing losses to banks and homebuyers.
The charge sheet has been presented in court under various sections of the Indian Penal Code related to criminal conspiracy, cheating, criminal breach of trust, forgery for cheating purposes, and use of forged documents as genuine. Additionally, charges under the Prevention of Corruption Act related to criminal misconduct by public servants have been invoked. The investigation revealed significant evidence indicating a broader conspiracy involving the misuse of official positions, fund diversion, and fraudulent behavior against homebuyers.
The CBI mentioned that it is currently probing 50 similar cases initiated by the Supreme Court against various builders and unidentified officials of financial institutions nationwide concerning alleged homebuyers’ fraud and fund diversion. Previously, the CBI had filed eight charge sheets in comparable cases involving multiple real estate companies and officials of banks and financial institutions.
