A Delhi High Court judge has stepped back from hearing a plea by Rani Kapur, the mother of late businessman Sunjay Kapur. She seeks to cancel a trust that allegedly deprived her of her estate and control over key Sona Group companies. The judge, Justice Vikas Mahajan, has directed the case to be listed before another bench.
Rani Kapur, an 80-year-old widow, is seeking to nullify the RK Family Trust/Rani Kapur Family Trust. She wants a declaration that the trust is void and an injunction against the defendants from using it. Kapur claims to be the sole beneficiary of her late husband’s estate, industrialist Dr. Surinder Kapur, who passed away in 2015.
Despite being the rightful heir, Kapur alleges that her estate was transferred to a new trust without her consent. She accuses the defendants of fraud and collusion, claiming that she was misled into signing documents that divested her of her estate. Kapur is demanding the restoration of her estate to its original state before the trust was created.
