Delhi High Court Quashes Criminal Proceedings Against Security Guards

The Delhi High Court has dismissed criminal charges against two security guards accused of restraining and offending a woman while preventing her entry into a private office. The court ruled that the case stemmed from a family dispute and was an abuse of legal process.

The incident, dating back to September 18, 2015, involved the widow of a senior executive of the VLS Group of Companies who alleged mistreatment by the guards. The court noted that the guards, newly appointed at the time, were simply carrying out their duties by preventing unauthorized access to the office premises.

According to the court, the guards had a duty to ensure security and had not violated any legal rights of the complainant. The charges of wrongful restraint and outraging modesty were found unsubstantiated as there was no evidence of sexual intent or misconduct by the guards.

The court highlighted that the dispute arose from conflicts within the complainant’s family and that the guards were unfairly targeted. Terming the case an abuse of legal process, the Delhi High Court dismissed all charges and proceedings against the security guards.
