The Delhi High Court has requested the Delhi Police to respond to a bail plea filed by former AAP councillor Tahir Hussain in connection to the 2020 riots. Hussain also seeks condonation for a 67-day delay in appealing against a Karkardooma court’s order.
The court scheduled the matter for July 16 and noted that the Delhi Police, represented by Additional Solicitor General S.V. Raju, sought time to address both the appeal and the delay condonation application. In a previous ruling, the Karkardooma court had rejected Hussain’s bail plea after finding a prima facie case against him.
The rejection of Hussain’s fresh plea was confirmed by Additional Sessions Judge Sameer Bajpai, citing the Supreme Court’s denial of bail to alleged key conspirators Umar Khalid and Sharjeel Imam. The trial court agreed with the prosecution’s stance that no significant changes had occurred since the previous bail application rejection.
The Supreme Court had earlier denied bail to Umar Khalid and Sharjeel Imam, citing prima facie grounds under the UAPA. However, bail was granted to five other accused in the case. The court also granted interim bail to two others while considering the impact of prolonged incarceration on bail decisions under the UAPA.
