Former Rajasthan minister Mahesh Joshi faced a setback as a special court rejected his request for release, citing the legality of his arrest in connection with the Jal Jeevan Mission scam. The court ruled that the Anti-Corruption Bureau had followed proper procedures, including informing Joshi’s family members promptly through verbal and electronic means, thus deeming the arrest lawful.
Joshi’s defense argued that essential legal steps were not adhered to during his arrest and subsequent remand, as mandated by the Supreme Court’s directives. However, the prosecution contended that the arrest was conducted in accordance with the law, with officers informing Joshi’s family members at his residence before taking him into custody.
Special Judge Rajesh Kumar Dadiya emphasized the importance of protecting the rights of the accused under the Bharatiya Nagarik Suraksha Sanhita. The court noted that Joshi’s legal representatives were present during the remand application, indicating that due process was followed, leading to the dismissal of Joshi’s plea challenging the legality of his arrest.
