The Ministry of Home Affairs has implemented the Immigration and Foreigners (Amendment) Rules, 2026, bringing significant changes to the registration process for foreigners in India. Effective immediately, the new rules modify the registration timeline for foreigners residing in the country. Previously, registration had to be done within fourteen days after 180 days of arrival, but now, it can be completed anytime before the 180-day period ends.
Moreover, the amended rules now allow delayed registration only under exceptional circumstances, emphasizing that late registration will be permitted solely in emergent situations. Notably, the rules exempt children with claims to both Indian and foreign citizenship if one parent is an Indian citizen and intends to retain the child’s Indian citizenship under the Citizenship Act, 1955.
Additionally, the updated regulations refine the appeals process for individuals aggrieved by civil authorities’ directives under the Immigration and Foreigners Act, 2025. Appeals must be lodged with the Commissioner, Bureau of Immigration, within 30 days through the designated online platform. The Commissioner is mandated to issue a reasoned order within 60 days of receiving the appeal, after a fair hearing.
The amendments, authorized under Section 30 of the Immigration and Foreigners Act, 2025, aim to enhance compliance procedures and regulatory oversight for foreign nationals residing in India.
