Top Senate Democrats are demanding that the Trump administration return over $130 billion in tariffs deemed illegal by the Supreme Court. They argue that this money was unlawfully taxed from American businesses and consumers. The lawmakers, including Senate Democratic Leader Charles E. Schumer and others, insist that the administration should start issuing automatic refunds instead of requiring small businesses to pursue legal action.
Following a 6-3 Supreme Court ruling that the President had exceeded his authority in imposing the tariff regime, the senators criticized Treasury Secretary Scott Bessent’s handling of the situation. They highlighted Bessent’s comments post the ruling, where he seemed reluctant to refund the tariff revenue collected. The senators emphasized that the money belongs to the businesses and individuals who were unlawfully taxed.
The lawmakers have outlined four demands for the administration. They have called for US Customs and Border Protection to initiate automatic refunds for tariffs and customs duties collected under IEEPA since January 20, 2025. Additionally, they seek a transparent and speedy refund process that prioritizes small businesses. The senators have set a public timeline of no more than 90 days for disbursements and urged an end to any delays or denials of refunds pending further litigation.
More than 20 Democratic senators, including Angela Alsobrooks, Richard Blumenthal, and Amy Klobuchar, have signed the letter demanding the return of the illegal tariffs. The tariffs, imposed under the International Emergency Economic Powers Act, faced legal challenges from importers and business groups who argued that the executive branch had overstepped its statutory authority.
