The Supreme Court has taken note of a plea from a Chinese national requesting permission to travel back home briefly to see his sick mother. The court emphasized the humanitarian aspect of the matter and involved the Ministry of External Affairs due to the lack of an extradition treaty between India and China.
The petitioner, Liu Fengfei, is contesting a decision by the Allahabad High Court that denied him the opportunity to visit his mother in Nanyang city, Henan Province, China, for two months. His mother is reported to be battling cancer and in a critical condition.
Highlighting the absence of an extradition agreement between the two nations, the Supreme Court decided to include the Ministry of External Affairs to explore ways to allow the petitioner to be with his mother during this difficult time. The case has been scheduled for further hearing in the week starting August 10.
Liu is currently facing legal proceedings in Uttar Pradesh’s Gautam Budh Nagar under various sections of the IPC and the Information Technology Act. He had approached the Allahabad High Court seeking permission to visit his mother on compassionate grounds, but the state government opposed his plea citing flight risk concerns.
