The charge sheet in the case was filed in February 2026, but prosecution sanction was pending. The court expressed surprise at the delay in granting sanction for prosecution. The appellant’s counsel argued that due to the delay, Mehta should be released on bail until trial.
The Supreme Court agreed with the argument, stating that a delay in granting prosecution sanction cannot be used against a citizen’s liberty. The court found the appellant’s continued detention unnecessary and directed his release on bail. The conditions of bail included not influencing anyone related to the case and attending trial proceedings diligently.
