The conviction and seven-year jail term of Aam Aadmi Party (AAP) MLA Chaitar Vasava have plunged the party’s Gujarat unit into turmoil. Legal experts suggest Vasava may lose his Assembly membership unless he receives relief from a higher court. The verdict in a 2023 case involving alleged assault and obstruction of forest department personnel has raised concerns about the AAP’s legislative strength in Gujarat.
This development is a blow to the AAP in Gujarat, which has been grappling with organizational and political challenges despite winning five seats in the 2022 Assembly elections. Vasava, a prominent tribal leader for the AAP in South Gujarat, was sentenced along with eight others, including family members. The court also imposed a fine of Rs 25,000 on each convict.
Legal experts emphasize that Vasava’s immediate recourse is to challenge the verdict in a higher court to suspend the sentencing. If the sentence stands, Vasava faces the risk of losing his membership as per the law. The outcome of the appeal will be crucial in determining his future as an MLA.
Former Gujarat High Court Advocates’ Association president, Brijesh Trivedi, highlights the importance of the appeal process in deciding Vasava’s fate as an MLA. The appellate court will scrutinize the trial court’s handling of evidence to determine any legal flaws. Vasava’s legal team is expected to file an appeal before the Gujarat High Court within the stipulated time frame.
