The Allahabad High Court has granted bail to a man who posted “Pakistan Zindabad” on Instagram right after the Pahalgam terror attack in Kashmir, which resulted in the deaths of 26 individuals, including tourists and a local. Faizan, the accused, was arrested under various sections of the Bharatiya Nyaya Sanhita. The court considered the nature of the offense and the evidence before ordering his release.
According to the prosecution, the accused shared the controversial post on his Instagram account following the tragic incident in Pahalgam. The defense argued that while the post may be objectionable, it did not violate the specific section under which the applicant was charged. The defense contended that merely expressing support for an enemy country does not necessarily constitute an offense under the relevant section.
Senior Advocate N.I. Jafri, representing the applicant, highlighted that the chargesheet had been filed, and the accused had been in custody since May 3, 2025, without the need for further interrogation. Despite opposition from the Uttar Pradesh Police, the court, considering various factors, including the overcrowded jails and pending cases, granted bail to the applicant. The court imposed specific conditions on the release, emphasizing cooperation in the trial and refraining from posting objectionable content on social media.
