In a significant development, BJP leader and Member of Parliament Harsh Mahajan has received legal relief in the pending Rajya Sabha election petition. The Himachal Pradesh High Court dismissed an application filed by senior Congress leader Abhishek Manu Singhvi challenging the necessity of witness examination and cross-examination in the matter. The court emphasized that evidence and witness examination are crucial for a fair adjudication process in election petitions.
The court ruled that the election petition process is trial-based, requiring evidence and witness examination for a fair trial. It deemed the list of witnesses submitted by BJP MP Mahajan as valid and in line with legal procedures. Consequently, Singhvi’s application was rejected. This decision is viewed as a significant step towards upholding transparency and due process in election-related disputes.
Advocate Thakur highlighted the importance of witness examination in uncovering the truth and ensuring justice. Harsh Mahajan expressed satisfaction with the court’s decision, stating that attempts to suppress the truth have failed. He criticized the Congress leadership for trying to avoid a fair trial, emphasizing the importance of facts and evidence in legal proceedings.
The matter will now progress with the examination of evidence and witnesses as part of the trial process. In the February 2024 Rajya Sabha election, Mahajan emerged as the winner through a draw of lots despite both him and Singhvi securing an equal number of votes. Following the poll, six Congress MLAs who cross-voted were disqualified by the party, leading to their vacant positions.
