Chief Justice of India Justice Surya Kant emphasized the importance of promoting mediation within the judiciary, highlighting its effectiveness in resolving disputes. Speaking at a State-level symposium on ‘Mediation: Dialogue as Cornerstone of Justice’, he noted that mediation is now a preferred mode of dispute resolution rather than an alternative method. The Chief Justice pointed out that mediation is supported by the Mediation Act of 2023, making resolutions by mediators legally enforceable.
Mediation, according to Justice Surya Kant, not only helps in reducing court caseloads but also facilitates quick and amicable dispute resolutions. He mentioned that special courts, especially those dealing with family disputes, have contributed to some reduction in caseloads. The Chief Justice also highlighted the popularity of mediation in foreign countries due to its cost-effectiveness and time efficiency compared to arbitration.
Justice Surya Kant urged Bar Associations to encourage people to opt for mediation as a means of settling disputes. He stressed the importance of people having trust in the mediator, emphasizing that mediation through courts is highly prioritized due to the faith people have in the judiciary.
