The High Court highlighted Khan’s alleged role in the conspiracy leading to fatalities during the riots as established. It expressed apprehension that Khan might flee if granted bail and could tamper with prosecution witnesses. The judgment followed the court reserving its decision on Khan’s plea earlier.
During the proceedings, the court noted WhatsApp chats indicating Khan’s active participation in the alleged conspiracy. Khan’s defense argued that the messages only discussed organizing peaceful protests, not inciting violence. However, the Bench suggested the chats demonstrated Khan’s involvement in the conspiracy.
The defense emphasized the lack of incriminating evidence like weapons or money against Khan. It claimed he played a minor role in the conspiracy and sought bail on par with other co-accused. The prosecution countered, likening Khan’s role to prominent figures Umar Khalid and Sharjeel Imam rather than those granted bail.
