The Delhi High Court has approved a 45-day interim bail for a murder case accused to attend to his sick wife and three young kids. The bail was granted as the applicant’s wife needed a specific surgery, and there was no one else to care for the children during her treatment. Despite no opposition from the prosecution, the court considered the family’s situation and allowed the temporary release.
Justice Girish Kathpalia highlighted the need for the accused to support his family during the wife’s medical procedure. The court emphasized that the lack of a status report from the prosecution indicated a lack of objection to the bail request. Rejecting claims of available relatives to care for the children, the court stressed the importance of the accused’s presence during his wife’s surgery.
The State’s failure to provide a written status report on alternative caretakers led to the court’s decision in favor of granting bail. The court acknowledged the postponed surgery due to childcare issues and deemed the circumstances appropriate for temporary relief. The accused, Furkan alias Faizan, is required to furnish a personal bond of Rs 10,000 for the release, as directed by Justice Kathpalia.
