The Delhi High Court has approved a 90-day interim bail for a woman accused in a fraud case to care for her sick two-year-old daughter. Justice Girish Kathpalia emphasized the crucial need for the mother’s presence and care for the infant’s well-being. The bail was granted considering the child’s medical requirements and emotional support.

The accused sought bail in connection with a case filed at Rajouri Garden police station under specific sections of the Bharatiya Nyaya Sanhita (BNS). The court noted that the primary allegation against the accused was related to suspicion of involvement in the fraud. Despite opposition from the prosecution, the court prioritized the child’s special needs due to her tender age.

Rejecting the prosecution’s argument that other relatives could care for the child, Justice Kathpalia highlighted the irreplaceable role of a mother in providing physical touch and comfort to an infant. The court’s decision to grant bail was based on ensuring the child’s access to her mother during the illness period. The accused was directed to furnish a personal bond and a surety for release.

The Delhi High Court’s order allowed the accused’s release on interim bail for 90 days, with specific conditions to be met. The court instructed immediate communication of the order to the jail superintendent for necessary action.
