The Delhi High Court has approved a 15-day interim bail for a defendant in a dowry death case to assist in his minor daughter’s school enrollment. Justice Girish Kathpalia granted the bail, noting the necessity for the defendant’s presence to complete the admission process for his daughter, who is currently staying with her grandparents. The court emphasized that the bail was solely for the purpose of ensuring the child’s school admission.
Justice Kathpalia considered the defendant’s plea for bail, acknowledging the need for his involvement in his daughter’s admission formalities. The court also took into account the defendant’s father’s statement, clarifying his employment status as self-employed and not a laborer in a factory. The High Court highlighted the importance of the defendant’s daughter’s education in granting the interim bail.
The prosecution, following instructions from the Investigating Officer, expressed no strong opposition to the interim bail, provided the defendant does not misuse the liberty granted. The court emphasized that the defendant’s release on bail was contingent upon a personal bond of Rs 10,000 and one surety of the same amount to be furnished to the trial court. Additionally, the court specified that no extension of the interim bail would be entertained.
