The Delhi High Court has provided temporary safeguard against arrest to a woman and her relative who claimed mistreatment by local police regarding a matrimonial conflict. The court expressed astonishment at the Investigating Officer’s handling of the case, stating that the petitioners should not face arrest until the next hearing.
Sonia Bansal and her sister’s brother-in-law sought protection from the Alipur Police Station, alleging harassment orchestrated by Sonia’s husband using his influence amid their marital legal battle. Despite the offenses being bailable, the IO reportedly refused bail bonds and persisted with harassment.
The court highlighted serious flaws in the investigation process and noted discrepancies in the notice issued by the IO, pointing out missing crucial information like the date for petitioner no. 1 to appear.
