The Delhi High Court has started criminal contempt proceedings against former Delhi Chief Minister Arvind Kejriwal and several AAP leaders. This action was taken due to a perceived “coordinated campaign” to scandalize the judiciary regarding the excise policy case. Justice Swarana Kanta Sharma mentioned that the criticism crossed the line into criminal contempt.
The court issued contempt notices to Kejriwal, former Deputy CM Manish Sisodia, MP Sanjay Singh, and AAP leaders Saurabh Bharadwaj, Vinay Mishra, and Durgesh Pathak. Justice Sharma emphasized that fair criticism and dissent are acceptable, but when attempts are made to scandalize the judiciary, action must be taken. The judge clarified that the proceedings aim to protect the institution of judiciary.
While criticism of judicial orders is allowed, the court highlighted the fine line between fair criticism and contempt of court. Justice Sharma pointed out that attempts to damage the judiciary through campaigns necessitate action. The judge also noted that the contempt proceedings were not driven by personal reasons but were focused on safeguarding the judiciary’s integrity.
In response to the initiation of contempt proceedings, Justice Sharma recused herself from further involvement in the excise policy case. This decision was made to avoid any perception of bias. The court had earlier considered appointing senior advocates as amici curiae after certain individuals abstained from proceedings. The CBI had challenged the discharge order related to the excise policy case, alleging favoritism towards specific liquor traders.
