The Delhi High Court has instructed the Deputy Commissioner of Police to investigate why an Investigating Officer sought permission to travel to Mumbai for the “search and arrest” of an accused who had interim protection from arrest. This directive came during a hearing on Amit Jain’s anticipatory bail plea related to an FIR at Subhash Place Police Station. The court noted that the IO’s request, approved by the ACP, was made while the accused had interim protection from arrest.
The court highlighted discrepancies in the document submitted, pointing out errors in the destination for which permission was sought. Additional documents were requested from Jain, who had already joined the investigation following interim protection granted earlier. The Investigating Officer was directed to provide Jain with a list of the required documents within two days, with assurance from Jain’s counsel of cooperation in supplying them to the agency.
Senior advocate Manu Sharma, representing the complainant, was allowed to submit additional documents before the next hearing scheduled for July 14. The court will continue the matter on that date for further proceedings.
