The Delhi High Court has announced its intention to issue an interim order safeguarding the personality and publicity rights of entrepreneur and Shark Tank India judge Aman Gupta. Gupta, who is also the co-founder of boAt Lifestyle, filed a suit alleging the unauthorized commercial exploitation of his identity on various digital platforms. Senior Advocate Diya Kapur, representing Gupta, presented evidence of the infringing content and past judicial orders related to personality rights cases.
The suit highlights multiple instances of unauthorized use of Gupta’s identity, including fake endorsements, unauthorized event bookings, merchandise sales under his name and catchphrase, AI chatbots impersonating him, and the circulation of objectionable content associated with him. It accuses unknown individuals, digital intermediaries, and online platforms of engaging in widespread and systematic commercial exploitation of Gupta’s personality, publicity, and trademark rights.
According to the plea filed in the Commercial Division of the Delhi High Court, Gupta, a well-known entrepreneur and public figure, has built significant goodwill and commercial value around his name, image, catchphrases, and trademarks. The suit alleges that various entities have been creating and disseminating manipulated content using Gupta’s likeness without consent, falsely implying his association with commercial activities for their benefit.
The legal action also addresses the unauthorized sale of merchandise, fraudulent event booking services, impersonation through AI chatbots, and the use of Gupta’s name in connection with explicit online content. It asserts that these activities violate registered trademarks, constitute passing off, infringe on personality and publicity rights, and deceive the public through false endorsements. The suit seeks injunctive relief against the defendants, including unknown individuals, intermediaries, social media platforms, and e-commerce entities.
