The Jamaat-e-Islami Hind (JIH) has expressed serious concerns about the Madhya Pradesh High Court’s ruling declaring the Kamal Maula Mosque (Bhojshala) a temple. The JIH believes this verdict raises questions about the credibility of the judicial system, protection of minority rights, religious freedom, and the secular nature of the country.
The court redefined the legal status of the Bhojshala complex, asserting it as a temple where Hindus have the right to worship. JIH President Syed Sadatullah Husaini emphasized the need for fairness and objectivity in judicial matters involving sensitive religious issues.
Husaini highlighted constitutional worries related to religious rights guaranteed under Articles 25 and 26 of the Constitution. He expressed concerns about the implications of the ruling on minority rights, religious freedom, communal harmony, and the secular fabric of India.
The JIH leader cautioned against altering established worship rights of one community in favor of another, as it may disrupt long-standing arrangements and jeopardize the principle of equal respect for all faiths. He stressed the importance of handling such matters cautiously in a diverse society like India.
Husaini also raised apprehensions about proposals to provide alternative land to the Muslim community instead of the disputed site. He underscored that religious rights are not merely about physical space but are deeply tied to historical continuity, identity, and collective memory.
The JIH president urged a careful approach to prevent reopening historical disputes over religious sites, emphasizing the need to uphold the Places of Worship (Special Provisions) Act, 1991. He emphasized the importance of maintaining constitutional morality, fairness, and justice for all communities in addressing such sensitive matters.
Husaini called for the judiciary to uphold not only impartiality in action but also the perception of impartiality. He expressed concerns that recent events risk undermining the credibility, dignity, and public trust associated with the judiciary.
The Muslim community, according to Husaini, will pursue legal remedies, including the possibility of filing an appeal, to ensure that their concerns are heard and addressed within the constitutional framework. He stressed the importance of safeguarding the rights and dignity of all citizens, especially minorities, to uphold the democratic and secular values of the nation.
