Leader of Opposition in the Lok Sabha, Rahul Gandhi is set to state his position in the Allahabad High Court regarding allegations made by a BJP worker claiming he holds dual citizenship. The High Court has directed the Uttar Pradesh Police to investigate the complaint and potentially file an FIR against Gandhi. This hearing precedes the enforcement of the court’s order to probe the matter.
The court had initially allowed the police to proceed with the inquiry and consider filing an FIR against Gandhi, but later revised its order to ensure the accused is given a chance to be heard before any action is taken. In a previous case in 2019, a plea seeking Rahul Gandhi’s disqualification over dual citizenship claims was dismissed by the Chief Justice of India. The current proceedings are crucial as they involve allegations of Gandhi being a British national, which could impact his eligibility to hold office.
Justice Subhash Vidyarthi, the single-judge bench handling the case, highlighted the need to address legal requirements before finalizing any judgment. The petitioner alleges that Gandhi’s British citizenship disqualifies him from contesting elections or serving as an MP, citing documents from UK authorities.
