A proposal by Senator Alex Padilla of California aims to update an immigration provision dating back to 1986, potentially benefiting over eight million long-term US residents. The Renewing Immigration Provisions of the Immigration Act of 1929 would offer a pathway to lawful permanent resident status for individuals residing continuously in the US for at least seven years.

This initiative, if passed, would extend eligibility to various groups, such as Dreamers, Temporary Protected Status holders, essential workers, and children of long-term visa holders. It could also assist highly skilled workers, notably H-1B visa holders facing prolonged waits for employment-based green cards, a situation often experienced by Indian professionals.

Senator Padilla emphasized the necessity of modernizing immigration laws to provide fairness and security to long-term residents who contribute significantly to the economy and society. The proposed amendment to Section 249 of the Immigration and Nationality Act would replace the fixed eligibility date with a rolling seven-year requirement, potentially benefiting a broader spectrum of individuals.

Senate Democratic Whip Dick Durbin is a co-sponsor of the measure, along with fourteen other senators, while Representative Zoe Lofgren is leading companion legislation in the House. The bill has garnered support from various labor, immigration, and civil rights organizations, highlighting the importance of updating immigration policies to reflect the current landscape.
