The Supreme Court has postponed the hearing on the Meghalaya government’s challenge against Sonam Raghuvanshi’s bail grant to July 21. Solicitor General Tushar Mehta, representing Meghalaya, requested a later hearing, leading to the adjournment. The government contests the bail, citing a typographical error in the arrest documents.
The apex court, comprising Justices M.M. Sundresh and P.B. Varale, initially scheduled the hearing for the day but rescheduled it for July 21. Meghalaya argues that lower courts erred in treating the typographical error as a significant procedural flaw. SG Mehta emphasized that the accused was informed about the case details.
During the previous hearing, SG Mehta highlighted the seriousness of the case and clarified that the arrest grounds were provided to the accused. The discrepancy was a typographical error in mentioning the relevant legal section. The court emphasized the need for the accused to be informed about the case’s background.
The Meghalaya government challenges the bail granted to Sonam Raghuvanshi, emphasizing the error in the arrest documents. The Supreme Court directed the government to submit original arrest memo copies and other documents given to Sonam. Earlier, the court had issued notice to Meghalaya but did not halt the High Court’s order as the accused had already been bailed.
