Supreme Court dismisses PIL on vacancies in Human Rights Commission

The Supreme Court rejected a PIL seeking to fill vacant positions in the Uttar Pradesh Human Rights Commission and establish a standard operating procedure for timely appointments in human rights bodies nationwide. The Court, led by Justices Vikram Nath and V. Mahadevan, questioned the petition’s validity under Article 32 of the Constitution and advised the petitioner to seek redress from the Allahabad High Court.

The petitioner’s counsel mentioned ongoing issues in the National Human Rights Commission (NHRC) before the apex court, contrasting them with the current plea focused on vacancies in state human rights commissions, particularly in Uttar Pradesh. Despite the counsel’s efforts to highlight vacancies in various state human rights commissions, the Court declined to address the matter, suggesting the petitioner approach the High Court instead.

The plea was withdrawn by the petitioner, with the option to approach the Allahabad High Court, leading to the Supreme Court dismissing the case. The petition had urged the expeditious filling of vacant positions in the Uttar Pradesh Human Rights Commission, advocating for a uniform procedure to ensure timely appointments and prevent prolonged vacancies in human rights bodies.
