The Supreme Court has issued a notice to the Assam government regarding a bail plea filed by Shyamkanu Mahanta, an accused in the case related to singer Zubeen Garg’s death in Singapore last year. The court’s decision came during the hearing of a special leave petition filed by Mahanta challenging the Gauhati High Court’s denial of bail. The matter is expected to be listed on August 10, according to the official case status.
Last month, the Gauhati High Court turned down Mahanta’s bail plea, citing the seriousness of the allegations against him and evidence suggesting his active involvement in the alleged conspiracy. The court mentioned the lack of proper safety arrangements and medical facilities for the deceased singer despite his health condition. It noted a potential flight risk if Mahanta were to be released on bail, pointing out his travel to Malaysia post-incident and subsequent arrest in Delhi.
The High Court highlighted the alleged conspiracy involving Mahanta and other accused individuals in organizing a yacht party where the singer was supplied alcohol without medical assistance. Concerns were raised about witness tampering due to the large number of witnesses cited by the prosecution. The court emphasized that the detention period was not prolonged and that a special court had been set up for the trial. Mahanta, known for organizing the Northeast festival, has been in jail for several months in connection with the case.
The case revolves around the death of Zubeen Garg, who passed away while swimming near Lazarus Island in Singapore a day before a scheduled performance. An SIT formed by Assam Police’s CID conducted an extensive investigation and filed a chargesheet naming seven accused, including Mahanta. The Assam Chief Minister labeled the case as “plain and simple murder.” While Singapore Police found no foul play, Assam authorities maintain that foreign findings won’t impact the ongoing trial in the state.
