The Supreme Court has expressed dissatisfaction with the Kerala Police for not registering a formal FIR promptly after receiving a complaint by post. The Court directed the Assistant Commissioner of Police, Ernakulam district, to personally appear and provide an explanation. The Court found the state of Kerala’s affidavit unsatisfactory for failing to address why a formal FIR was not filed upon receiving the complaint.
The apex court emphasized the importance of registering the FIR promptly after acknowledging the receipt of the complaint by the Assistant Commissioner of Police, Ernakulam district. The Court has extended interim protection to the petitioner until the next hearing date, preventing coercive action against the petitioner in connection with a specific case.
During a previous hearing, the Supreme Court had questioned the Kerala Police regarding allegations of inaction on a complaint related to outraging the modesty of a woman from the SC/ST community. The Court highlighted the broader implications of police inaction on public trust and warned of strict consequences if authorities were found negligent.
