In a significant move to aid victims of road accidents and their families, Finance Minister Nirmala Sitharaman declared during the Union Budget presentation for 2026-27 that the interest accrued on motor accident compensation claims will be fully exempt from income tax.

This initiative, designed to ensure that victims receive their full compensation without any deductions, also eliminates Tax Deducted at Source (TDS) on the interest payments.

The exemption from income tax for interest components awarded by Motor Accident Claims Tribunals (MACT) is aimed at providing relief to victims or their dependents who have been facing tax liabilities on these amounts, often leading to reduced financial support for medical care, rehabilitation, and livelihood restoration.

The Finance Minister highlighted that this tax exemption specifically applies to interest awarded to individual claimants, recognizing the compensatory and humanitarian nature of these awards.

Road accidents continue to pose a significant public health and economic challenge in India, resulting in numerous fatalities and injuries annually, leading to prolonged legal battles for compensation.

By removing the tax burden on interest awarded in motor accident cases, the government aims to make the compensation more meaningful and victim-centric, aligning with efforts to improve the quality of life and support vulnerable sections of society.

Legal experts, victim rights groups, and insurance stakeholders have welcomed this move, as it is seen as addressing a longstanding inequity and could potentially expedite claim resolutions while safeguarding awards meant for rehabilitation.

This tax exemption proposal is part of Finance Minister Sitharaman’s broader strategy to simplify compliance and provide targeted relief amidst ongoing economic reforms, with a focus on manufacturing, infrastructure, and fiscal consolidation in the budget, which includes a projected capex hike to Rs 12.2 lakh crore.

The full exemption of interest on motor accident compensation claims from income tax is expected to benefit numerous affected families, ensuring that justice in such cases is not compromised by fiscal deductions.
