What is a Power of Attorney?

A Power of Attorney (POA) is a legal instrument that enables you (the principal) to grant authority to another person (the attorney or agent) to act on your behalf in specified matters.

For NRIs, this becomes particularly useful for:

  • Managing or selling immovable property in India
  • Handling financial and banking transactions
  • Representing before government offices
  • Conducting legal proceedings or tax matters

Types of Power of Attorney

1. General Power of Attorney (GPA)

A General Power of Attorney authorizes your representative to act broadly on your behalf — across multiple matters like property management, financial dealings, and general representation before authorities.

Example Use:
If you want someone to manage your property, collect rent, pay bills, or represent you before authorities in India while you live abroad, a General POA is suitable.

GENERAL POWER OF ATTORNEY

I, [Your Full Name], residing at [Your Address], hereby appoint [Attorney’s Full Name], residing at [Attorney’s Address], as my lawful Attorney to act for me and in my name in all matters concerning my movable and immovable properties in India and to do all acts, deeds, and things necessary in connection therewith.

My Attorney shall have full authority to manage, lease, rent, collect rents, pay taxes, represent me before government authorities, banks, or any other institutions, and to sign, execute, and deliver all necessary documents in my name.

This Power of Attorney is valid until revoked in writing by me. I hereby ratify and confirm all lawful acts done by my Attorney under this Power of Attorney.

2. Special Power of Attorney (SPA)

A Special Power of Attorney limits your representative’s authority to a specific task or transaction. Once that purpose is completed, the POA automatically becomes void.

Example Use:
You can authorize someone only to sell one particular property, complete a banking transaction, or represent you in one specific case.

Special Power of Attorney Format

SPECIAL POWER OF ATTORNEY

I, [Your Full Name], residing at [Your Address], do hereby appoint [Attorney’s Full Name], residing at [Attorney’s Address], as my lawful Attorney to perform the following specific acts on my behalf in India:

1. To sell my property located at [Property Address].
2. To sign the sale agreement, execute the sale deed, and register the same before the concerned Sub-Registrar.
3. To receive the sale consideration and issue receipts thereof.
4. To appear before authorities, execute and submit necessary documents, and do all lawful acts necessary to complete the said transaction.

This Power of Attorney is limited to the above-mentioned purpose and shall remain valid until the completion of the transaction or until revoked in writing.

How to Execute a Power of Attorney as an NRI

Follow these steps to make your POA legally valid in India:

  1. Draft the POA – Use one of the templates above.
  2. Sign in front of a notary or Indian Embassy official – This makes the document valid internationally.
  3. Get the document attested – The Indian Consulate or Embassy must attest your POA.
  4. Send it to India – Send the original POA to your representative in India via courier.
  5. Adjudicate in India – The attorney must submit it to the local Sub-Registrar Office within 3 months for stamping and adjudication.

Important Notes

  • Always appoint a trusted person as your attorney.
  • Clearly mention validity and scope of authority.
  • Keep copies safely with both parties.
  • In real estate transactions, registration of POA may be mandatory under local laws.

NRI Attestation & Registration Steps

Once you’ve filled in your Power of Attorney (GPA or SPA), you need to get it attested and registered properly for it to be legally valid in India.

Step 1: Prepare the POA

  • Draft the Power of Attorney on plain paper.
  • Leave space for your signature and witnesses.

Step 2: Visit the Indian Embassy or Consulate

  • Take your passport, address proof, and the POA draft.
  • Sign the POA in front of the Consular Officer (do NOT sign it in advance).
  • The officer will attest and stamp the document.

Step 3: Send the Attested POA to India

  • Courier the original attested copy to your attorney or family member in India.

Step 4: Adjudication / Registration in India

  • General POA: To be adjudicated (stamped) at the District Collector / Sub-Registrar office within 3 months of receipt.
  • Special POA (for property): Must be registered at the Sub-Registrar Office where the property is located before use.

Validity and Legal Notes

  • Attach copies of your passport and visa with the POA.
  • Use stamp paper of appropriate value during adjudication (usually ₹100 or as per state law).
  • The POA remains valid until revoked or the purpose is fulfilled (in the case of Special POA).
  • Registration adds extra legal authenticity, especially for property transactions.
