The Delhi High Court stressed the need to balance the operation of bars and pubs with citizens’ and children’s right to a peaceful environment. This observation came during the disposal of a petition against Bunon Bar and Lounge for allegedly exceeding permissible operating hours. The court highlighted that regulatory bodies must address citizens’ complaints in line with the law.
The petitioner accused the bar of operating beyond allowed hours, even until 4.30 a.m., and of issuing handwritten slips instead of GST bills. Despite complaints to authorities like the Delhi Police Commissioner and the Excise Department, no action was taken. Referring to the regulatory framework, the court noted the specific hours for liquor sale under the Delhi Excise Act, 2009, and the process for handling public nuisance complaints.
In a firm stance on public authorities’ accountability, the court emphasized that citizen complaints should not be ignored in a lawful society. It underscored the importance of timely and effective enforcement of laws to maintain public trust in governance. The court directed the Excise Commissioner to address the petitioner’s concerns within two months and urged all relevant authorities to collaborate for a proper resolution.
