Kerala Police has requested a Thiruvananthapuram court to revoke the anticipatory bail granted to expelled Congress MLA Rahul Mamkootathil due to an alleged breach of bail conditions. Mamkootathil is accused of attempting to contact the survivor in a second rape case, which violates the condition prohibiting any communication with the complainant. The police claim that Mamkootathil’s alleged phone call to the survivor on February 17 constitutes a violation of the bail condition.
The survivor, a 23-year-old woman from Bengaluru, lodged a complaint with the Special Investigation Team (SIT) after Mamkootathil’s attempted phone contact. She clarified that she did not answer the call. Police submitted the survivor’s complaint and digital evidence supporting the alleged breach to the court. Investigators argue that the breach is serious enough to warrant the cancellation of Mamkootathil’s bail.
Following the police’s petition, the court has instructed Mamkootathil to appear in person and provide an explanation. He is required to appear before the court within this month. The second rape case against the MLA was initiated based on the complaint filed by the 23-year-old woman. While the anticipatory bail protected him from arrest, it was contingent on complying with the specified conditions, including refraining from contacting the survivor.
The potential cancellation of anticipatory bail could lead to custodial proceedings against the accused. The court is expected to assess whether the alleged phone contact constitutes a deliberate violation of the bail conditions before making a final decision.
