The Patna High Court has provided interim relief to Rashtriya Janata Dal MLA Osama Shahab, preventing any coercive actions against him temporarily. The court, under Justice Ajit Kumar, has also instructed the state government to furnish the case diary related to the issue. This decision came during the hearing of Shahab’s anticipatory bail plea regarding a case at Mahadev Police Station, Siwan.
Shahab, in his plea, highlighted that no anticipatory bail application had been filed in either the High Court or the Supreme Court of India concerning this matter. He emphasized that there were no ongoing proceedings in lower courts, hence seeking direct relief from the High Court. The case, registered under various sections of the Bharatiya Nyaya Sanhita, involves allegations stemming from a land dispute and purported threats made by Shahab.
According to the First Information Report, the complainant, who had purchased a plot of land and initiated construction, was allegedly threatened by Shahab over the phone to cease construction. Subsequently, Shahab, accompanied by a group of armed individuals, reportedly vandalized the property and assaulted the laborers. Shahab’s legal counsel argued that the disputed land rightfully belongs to him and accused the complainant of encroachment and using forged documents for construction.
While three criminal cases are pending against Shahab, his defense team asserted that the current issue primarily revolves around the property dispute and alleged political animosity. The court has instructed the state government to present the case diary in the upcoming hearing, where further proceedings and a decision on the anticipatory bail plea will be determined.
