The Supreme Court criticized the Haryana Police for their handling of a sexual assault case involving a 3.8-year-old child in Gurugram. The Court noted a perceived effort to discredit the minor victim and downplay the seriousness of the offense. In response, a Special Investigation Team (SIT) of three senior IPS officers has been appointed for a thorough investigation.
The Court expressed concern over the police’s actions, stating that there seemed to be an attempt to undermine the victim’s account and exaggerate the parents’ concerns. It emphasized that the evidence supported a case under Section 6 of the POCSO Act and criticized the police for unjustifiably reducing the severity of the offense. The shifting stance of the Gurugram Police and the inconsistencies in their investigation were also highlighted as worrisome.
Additionally, the Supreme Court reprimanded the Child Welfare Committee (CWC) for its report, which was deemed to further victimize the child. The Court raised doubts about the competence of CWC members in handling such sensitive matters and requested explanations from the Gurugram CWC officials. It also directed the Gurugram Police officers involved in the case to be removed from the investigation pending disciplinary actions.
