The Supreme Court has temporarily stopped the implementation of a judgment by the Allahabad High Court that criticized Uttar Pradesh Additional Chief Secretary, Home, Sanjay Prasad. This decision came during a hearing of a special leave petition filed by Prasad challenging the High Court’s ruling in a case related to the recovery of a minor girl. The apex court has also directed that the judgment be sent to the Department of Personnel and Training for review regarding Prasad’s future roles.
Granting permission to file the special leave petition, the Supreme Court has issued notices to the concerned parties and scheduled a further hearing after ten weeks. The bench led by Justice Mishra ordered that the directions given by the High Court in the disputed judgment should be put on hold during this period. The petition to the Supreme Court stemmed from a case heard by Justice Vinod Diwakar of the Allahabad High Court concerning a missing minor girl.
The Allahabad High Court, while noting that the girl had been found and reunited with her family, made significant comments on the operations of the Home Department and the behavior of senior officials. In particular, the judgment highlighted the actions of Sanjay Prasad, Additional Chief Secretary (Home), Uttar Pradesh Government, stating that his conduct in the case could not be ignored. Consequently, the High Court instructed its Registrar to forward a certified copy of the judgment to the Department of Personnel and Training for appropriate consideration regarding Prasad’s suitability for future assignments.
