The Union Ministry of Health and Family Welfare has made amendments to the Clinical Establishments (Registration and Regulation) Act, 2010, aiming to lessen the compliance burden. Criminal penalties for procedural lapses will be replaced with a fair administrative mechanism, as stated by an official on Thursday.
These reforms seek to enhance trust-based governance, ease of doing business, and regulatory enforcement while upholding patient safety and healthcare quality nationwide. The amendments, notified on June 22, align with the Jan Vishwas (Amendment of Provisions) Act, 2026, published in the Official Gazette on April 8, 2026.
The Clinical Establishments Act oversees the registration and regulation of clinical establishments across India, setting minimum facility standards. The changes reflect recommendations from a high-level committee on regulatory reforms, emphasizing the government’s dedication to transparent and citizen-centric regulatory frameworks.
By introducing a balanced administrative mechanism in place of criminal penalties, the reforms aim to streamline business operations in healthcare without compromising patient care standards. The Jan Vishwas Act, 2026, streamlines provisions across various Central Acts, including 35 provisions in the health sector under the Ministry of Health and Family Welfare.
Under the revised framework, fines have been replaced with penalties in specific sections of the Act, shifting from criminal prosecution to administrative adjudication. The amendments also introduce graded penalties for company violations, ensuring enforcement aligns with the severity of the offense. The adjudicating authority’s scope has been broadened to enhance transparency and accountability in enforcement proceedings.
These changes include structured adjudication processes, opportunities for hearing before penalties, penalty recovery mechanisms, and an appeal framework for affected parties. The reforms aim to promote voluntary compliance, reduce litigation, and maintain regulatory oversight over clinical establishments.
