A US federal judge is seeking a fuller explanation from the Justice Department before approving its request to dismiss criminal charges against industrialist Gautam Adani. While experts suggest that the case is likely to be dropped, the judge’s scrutiny aims to ensure the integrity of the judicial process. Judge Nicholas Garaufis has directed the Justice Department to provide detailed reasons for its request to dismiss the indictment against Adani and seven co-defendants.
John C. Coffee, a law professor at Columbia Law School, emphasized that prosecutorial discretion lies with the executive branch and cannot be overturned by the court. Although the judge may ask for justification, the ultimate decision rests with the executive branch. Former US Attorney Barbara McQuade noted that judges may seek further explanation to prevent the misuse of authority by the Justice Department.
Renowned Indian senior advocate Harish Salve described the judge’s order as a routine procedural requirement rather than a challenge to the Justice Department’s decision. Salve highlighted that the court’s role is to review the reasons provided by the government before dismissing a case. The Justice Department is expected to submit a detailed explanation by July 13, as directed by Judge Garaufis.
Paul Rosenzweig, a former federal prosecutor, believes that the Justice Department is likely to prevail in the case. While the proceedings could conclude swiftly if the court accepts the explanation, they may prolong if an independent lawyer is appointed to review the government’s reasons. The indictment against Adani and others, involving bribery and securities fraud in India, was returned by a federal grand jury in October 2024.
