US Supreme Court Invalidates Trump’s Emergency Tariffs, Welcomed by Business Groups

US business groups, advocacy organizations, and lawmakers have applauded a Supreme Court ruling that struck down President Donald Trump’s emergency tariffs. The 6-3 decision found that the executive branch overstepped its authority by imposing import taxes using emergency powers, deeming many tariffs from the previous year illegal. Neil Bradley from the US Chamber of Commerce praised the ruling, citing relief for businesses and consumers who faced cost hikes and supply-chain disruptions due to the tariffs.

The US Chamber of Commerce’s executive vice president urged the administration to promptly refund unlawfully collected duties and reevaluate tariff policies to boost economic growth and reduce costs for families. We Pay the Tariffs, a coalition supporting small businesses, demanded swift and full refunds for billions of dollars in duties paid unnecessarily. Senator Mitch McConnell from Kentucky also supported the decision, highlighting the drawbacks of trade wars and their impact on domestic costs.

Edward Fishman, a former State Department and Treasury official now at the Council on Foreign Relations, noted that the ruling could restrict the use of tariffs as a quick-response geoeconomic tool. However, he mentioned that tariffs could still be utilized in trade negotiations through other legal means. Despite the positive reception, some business groups cautioned about lingering uncertainty, fearing the potential reintroduction of tariffs through different statutory avenues.
