Delhi High Court Acquits Man in 2012 Heroin Case Due to Procedural Lapses

The Delhi High Court has acquitted a man in a 2012 heroin recovery case under the NDPS Act, citing serious procedural lapses and inconsistencies in the prosecution’s case. The court overturned the conviction of Sunil alias Sunil Sharma, who was sentenced to 10 years in prison and fined Rs 1 lakh.

Officials from the Directorate of Revenue Intelligence had intercepted the accused at the Singhu border in 2012, where he was allegedly transporting one kilogram of heroin hidden in a car. However, the court found discrepancies in the handling of the contraband, sampling procedures, and inventory records by the prosecution.

The judgment highlighted that there were discrepancies in the quantity of heroin seized and the sampling process. The court also noted the lack of proper documentation regarding the custody and transfer of the seized material.

The court emphasized the importance of adhering to statutory safeguards in NDPS investigations and directed officials to strictly comply with the formalities to prevent miscarriages of justice in the future.
