Delhi High Court Upholds Maintenance Order for Wife Despite Husband’s Claims

The Delhi High Court has upheld a Family Court decision requiring a man to provide monthly maintenance to his wife under Section 125 of the CrPC. The court dismissed the husband’s appeal challenging the maintenance order, which granted Rs 3,000 per month to the wife along with litigation expenses of Rs 11,000.

The couple got married in May 2009 in Uttar Pradesh and later lived together in Delhi. The wife alleged mistreatment and assault by the husband, leading to their separation. The husband argued that the wife was not eligible for maintenance due to her undisclosed previous marriage status and questioned the basis for determining the maintenance amount.

Despite the husband’s objections, the court ruled in favor of the wife, emphasizing her entitlement to maintenance under Section 125 CrPC. The court highlighted the welfare-oriented nature of maintenance laws, aiming to protect women from destitution. Citing Supreme Court precedents, the court upheld the Family Court’s decision, stating limited grounds for revision in maintenance orders.
