The District Consumer Disputes Redressal Commission in Darjeeling, West Bengal, has instructed Amazon India and a seller on its platform to reimburse Rs 1.43 lakh to a customer. The consumer received a different Fujifilm camera model than the one ordered and faced challenges in obtaining a refund despite returning the product.
Soloman Lepcha from Darjeeling filed a complaint against Amazon Seller Services Pvt. Ltd. and Clicktech Retail Pvt. Ltd., citing service deficiencies and unfair trade practices related to a Fujifilm X-T5 mirrorless camera purchase. Lepcha discovered that the delivered camera was a different model upon receiving the package, not the Fujifilm X-T5 mirrorless camera he had requested.
After returning the incorrect product as instructed and not receiving the promised refund, Lepcha encountered issues with the refund process. Despite returning the camera and providing evidence of the error, the refund was not processed, and communication attempts were allegedly dismissed without valid reasons.
The consumer forum, ruling in favor of the complainant, ordered Amazon and the seller to repay the camera’s cost within 45 days. Additionally, the forum awarded compensation for mental distress, negligence, deficiency in service, and litigation costs. Interest at 9% per annum will apply to the refunded amount until payment, with provisions for legal action if the refund is not issued within the specified timeframe.
