Tesla and SpaceX CEO Elon Musk cautioned that individuals utilizing Grok AI for illicit content will face consequences equivalent to those for uploading illegal material. This statement follows the Ministry of Electronics and Information Technology’s crackdown on X Corp for its failure to prevent the dissemination of inappropriate content on its platform. Musk’s response came after DogeDesigner, a member of the DOGE team, raised concerns about Grok generating unsuitable images. Musk emphasized that the responsibility lies with the user, likening Grok to a pen that does not determine the content created.
The government instructed X Corp to submit an action taken report within 72 hours to ensure compliance in preventing the hosting and sharing of explicit content through AI-based services like Grok. Failure to adhere to these directives may result in legal repercussions under various laws, including the IT Act and IT Rules. The ministry mandated a thorough evaluation of Grok’s technical and governance frameworks to curb the production of unlawful content. Additionally, strict user policies, such as suspension and termination of violators, were emphasized, with a requirement for immediate removal of offending content without altering evidence.
Non-compliance with the regulations could lead to the loss of safe harbor protection under the IT Act and trigger penal measures under laws like the BNS and the Protection of Children from Sexual Offences Act. The Ministry of Electronics and Information Technology stressed the importance of adhering to these guidelines to avoid legal consequences for both the platform and its users.
