The Madras High Court has issued an interim order restraining the creators of the Tamil film ‘Happy Raj’ from utilizing a song originally composed by Ilaiyaraaja. The court found a prima facie case of alleged copyright infringement by adapting Ilaiyaraaja’s iconic composition “Podhuvaga En Manasu Thangam” without his permission.
Ilaiyaraaja filed a civil suit contending that the 1980 blockbuster song had been incorporated into ‘Happy Raj’ without proper authorization. The film, released on March 27, reportedly featured a modified version of the popular track, which the composer claims was used without his consent, violating his copyright.
The court directed that the disputed song should not be used in the film until further orders. Additionally, notices have been issued to the director and producer of ‘Happy Raj’ to respond to the allegations of unauthorized adaptation and commercial exploitation of the original composition.
The interim order could impact not only the film’s current theatrical run but also future television broadcasts, satellite telecasts, and releases on over-the-top (OTT) streaming platforms if the contentious portion is not removed or proper permission is not obtained from Ilaiyaraaja.
The case underscores the legal obligations of filmmakers and production houses regarding the use of existing musical works in new productions, emphasizing the statutory protection afforded to musical compositions under the Copyright Act. Ilaiyaraaja has been proactive in safeguarding his intellectual property rights, with this case being part of his efforts to enforce copyright protection over his extensive music catalog.
